On Monday, Ben Rhodes, the former national security adviser during the Obama administration, bragged that “foreign leaders are already having phone calls with Joe Biden”. Michael Flynn, President Trump’s first national security adviser, was thoroughly investigated for having the same communications with foreign leaders before President Trump officially became President on January 20, 2017.
The act in question that both Flynn and Biden violated is the Logan Act. Ironically, reports state that Biden was the one that suggested using the Logan Act against Flynn back in January of 2017, just days before President Trump was sworn in. The Logan Act is a law from 1799 that prohibits private citizens from talking about American foreign policy with foreign governments or representatives. Violation of the Logan Act is a felony punishable by up to 3 years in prison. Will Biden be treated the same as Trump’s adviser was?
