 No, President Trump Isn’t Suspending The 2020 Election

Despite the fact that Democrats vehemently claim Trump is going to change the date of the November election, he’s not. The fact of the matter is that under current law, President Trump can not cancel the election. The Constitution states that the federal elections shall occur on the First Tuesday after November 1. This year, election day is November 3. Unless the Democrat controlled House and Republican controlled Senate agree to change the law, the date of the November election will remain as November 3. So even if the election were postponed, it would be due to Congress. Afterall, the Constitution states that Congress has the sole power to determine the time, place, and manner of elections.

Furthermore, if the election were hypothetically postponed, the terms of President Trump and Vice President Pence would still expire on January 20, 2021. This means that if the election were to be postponed to a date after January 20, 2021, a complicated legal battle would likely come as a result. If the line of succession were utilized to determine who would become the President in the instance of a delayed election, Speaker of the House Nancy Pelosi would temporarily become the President. 

There is no need for the November election to be postponed, and it is currently impossible for President Trump to impose such a postponement. Joe Biden recently made the statement, “Mark my words I think he is gonna try to kickback the election somehow”. This claim is yet another baseless claim made by Joe Biden. The Presidential election will be held on November 3, 2020. Be sure to go out and vote that day to re-elect President Trump!
